We've been talking time and time again about the numerous problems displayed by
Apple's latest handset, the iPhone 4. And to be perfectly honest, we sort of expected at least a couple of users to be extremely discontent with all of these issues and take some legal action.
According to the
Boy Genius Report, this is exactly what happened, with two people from Maryland slapping both Apple and AT&T with a very
serious lawsuit. Apparently, the two plaintiffs have hired some pretty serious legal representation and the claims are pretty sever, as you'll be able to see for yourselves as follows:
General Negligence (APPLE and AT&T)
Defect in Design, Manufacture, and Assembly (APPLE)
Breach of Express Warranty (APPLE)
Breach of Implied Warranty for Merchantability (APPLE and AT&T)
Breach of Implied Warranty of Fitness for a Particular Purpose (APPLE and AT&T)
Deceptive Trade Practices (APPLE and AT&T)
Intentional Misrepresentation (APPLE and AT&T)
Negligent Misrepresentation (APPLE and AT&T)
Fraud by Concealment (APPLE and AT&T);
Naturally, this is a pretty serious situation, since it will certainly affect the two companies' public image (depending on the outcome of the lawsuit, of course). Plus, it's very likely that other lawsuits will follow, unless
Apple somehow manages to “magically” fix all of the iPhone 4's problems.
On the other hand, we're sort of sure that iPhone 4 sales will not record a serious drop, especially taking into account the fact that, after all, those people who would actually buy this handset with a clean conscience, despite of the many problems it has, can't be described as anything but hardcore fanboys (or fangirls).
